Terms of Service
Last updated: 18 October 2026
These Terms of Service (“Terms”) govern your access to and use of the Delrity website builder platform and related services (the “Service”), operated by Mzansi WebApps (“Delrity”, “we”, “us”). By creating an account or using the Service, you agree to these Terms.
1. Eligibility and accounts
You must be at least 18 years old and able to enter into a binding contract to use the Service. You are responsible for the accuracy of your account information and for keeping your login credentials secure. You are responsible for all activity that occurs under your account.
2. The Service
Delrity is a software-as-a-service platform that lets you build, customise, publish, and host professional websites using guided templates, and, on our Business plan, add a storefront to sell products (see “Selling on your website” below). Your site is published on a Delrity subdomain (for example, yourbusiness.delrity.com) or, on eligible plans, on a custom domain you connect. Features available to you depend on your subscription plan. We may add, change, or remove features over time.
3. Free trial and subscriptions
- We offer a 14-day free trial with no credit card required. The trial gives you our Business-level features, including storefront selling, with three exceptions that remain paid-only: connecting a custom domain, adding extra team members, and removing the “Powered by Delrity” branding. At the end of the trial, unless you subscribe to a paid plan, publishing and storefront checkout become unavailable until you subscribe. Nothing you have built or sold is deleted.
- Paid plans are billed monthly through our payment processor. By subscribing, you authorise us to charge the applicable fees to your chosen payment method.
- Subscriptions renew automatically each month until you turn off auto-renew. You may turn it off at any time; your subscription then ends at the end of the current billing period and you keep access until then.
- You can change plan from the billing page. An upgrade takes effect once you pay a prorated charge for the rest of the current billing period, and the new monthly price applies from your next renewal. A downgrade takes effect at the end of the billing period you have already paid for.
- If a payment fails, your subscription may enter a grace period. If it is not resolved, published sites may be suspended until payment is brought up to date.
4. Payment terms
Fees are stated on our pricing page and may change with reasonable notice. Fees are charged in advance for each billing period through our payment processor. Applicable taxes may be added to the fees. You are responsible for keeping a valid payment method on file. For refunds and cancellations, see our Refund Policy.
5. Your content
You retain ownership of the content you upload or create with the Service (“Your Content”). You grant us a limited licence to host, store, reproduce, and display Your Content solely as needed to operate and provide the Service, including publishing your website.
You are solely responsible for Your Content and for ensuring you have the rights to use it. You represent that Your Content does not infringe the rights of others or violate any law.
6. Acceptable use
Your use of the Service, and the content you publish, must comply with our Acceptable Use Policy. We may suspend or terminate accounts that violate that policy, with or without notice where necessary to protect the platform or others.
7. Website publishing
When you publish a website, we host and serve it from our infrastructure on a Delrity subdomain and issue an SSL certificate for it. You are responsible for the content and lawful operation of any website you publish. We may take a published site offline where required to comply with law, enforce these Terms, or protect the platform.
8. Custom domains
If you connect a custom domain, you are responsible for owning and maintaining that domain and for correctly configuring the required DNS settings. We provision hosting and an SSL certificate for verified domains, but we are not responsible for domains registered or managed with third parties, or for downtime caused by incorrect DNS configuration.
9. Organisations and team members
When you create an account, you create or join an organisation (a workspace) that owns your websites, billing, and settings. On our Business plan, an organisation’s owner may invite team members using a shareable invite link, up to the total number of members included in that plan. The owner is responsible for who they invite and for managing their team’s access to the organisation.
10. Selling on your website
On our Business plan, you can add a storefront to your website to sell products, using product listings, a shopping cart, checkout, order management, and coupons (“Commerce”). To accept online payments, you connect your own account with a supported payment provider (currently PayFast). Payments from your customers are processed and settled directly by that provider into your own account. You may also offer cash on delivery or pay on collection, in which case the customer pays you directly and you record the payment in your dashboard. We are not a party to the sale, we do not collect, hold, or redistribute your funds, and we do not store your customers’ card details.
On your behalf, we email your customers an order confirmation and a delivery or collection update, and give each order a private tracking page. You are responsible for the accuracy of what your store tells your customers.
You are solely responsible for your storefront, including pricing, product descriptions, tax, consumer-protection compliance, order fulfilment, and any refunds or disputes with your customers. We store your payment provider credentials in encrypted form so your storefront can operate; we cannot use them to access funds in your account. See our Privacy Policy for how order information is processed and retained.
If your website uses the Book / Pre-order section, you collect pre-orders and arrange payment, by bank transfer, yourself. Delrity does not process or hold those payments. You are responsible for the bank details you publish, for confirming payment and fulfilling each pre-order, and for how you use the personal information your visitors give you.
11. Intellectual property
The Delrity platform, including its software, templates, branding, and design, is owned by us and protected by intellectual property laws. These Terms do not grant you any rights in our intellectual property except the limited right to use the Service as permitted here.
12. Third-party services
The Service relies on third-party providers (such as payment processing, email delivery, and hosting), and, if you use Commerce, on the payment provider you connect. Your use of those integrations may be subject to the providers’ own terms. We are not responsible for third-party services.
13. Service availability
We work to keep the Service and published websites available and reliable, but we do not guarantee uninterrupted or error-free operation. Access may be affected by maintenance, updates, or factors outside our control, including third-party providers. We do not offer a formal uptime guarantee at this time.
14. Suspension and termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms, fail to pay applicable fees, or where required to protect the Service or comply with law. On termination, your right to use the Service ends and published sites may be taken offline.
15. Disclaimers
The Service is provided on an “as is” and “as available” basis. To the extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and uninterrupted or error-free operation.
16. Limitation of liability
To the maximum extent permitted by law, Delrity will not be liable for any indirect, incidental, or consequential damages, or for loss of profits, data, or goodwill, including in connection with a Commerce transaction between you and your customers. Our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months before the claim arose.
17. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, notify you. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
18. Governing law
These Terms are governed by the laws of the Republic of South Africa, and the courts of South Africa have exclusive jurisdiction over any dispute arising from them.
